Terms of Service

These Terms of Service ("Terms") govern your access to and use of BottleBuddy, including the BottleBuddy mobile application, website, APIs, support channels, and related services (the "Service").

By creating an account, accessing, or using the Service, you agree to these Terms, our Privacy Policy, and any additional terms presented to you for paid features or subscriptions.

2. What BottleBuddy is — and is not

BottleBuddy is a peer-to-peer listing and messaging platform. It helps private individuals coordinate the handover of refundable deposit bottles so that Collectors may redeem the deposit value themselves through applicable deposit-return systems.

BottleBuddy is not a party to any pickup, handover, cash exchange, deposit redemption, or other arrangement between users. We provide software and communication tools only.

You must be at least 16 years old, or the minimum age required by the laws of your country if higher, and legally capable of entering into these Terms. You may not use BottleBuddy if prohibited by applicable law or if we have suspended or terminated your account.

When you post a listing, you represent that:

When you accept or request a pickup, you agree to coordinate respectfully, attend at agreed times where possible, cancel promptly if plans change, and comply with local laws and deposit-return rules.

All pickup arrangements, bottle handovers, and cash/deposit-value arrangements are solely between the users involved. BottleBuddy is not responsible for failed pickups, no-shows, incorrect counts, non-redeemable bottles, disputes about cash, or unsuccessful redemption.

7. Cash and deposit-value exchanges

BottleBuddy does not process, hold, guarantee, escrow, insure, refund, or enforce any cash or deposit-value exchange between users. If users agree that a Collector will hand cash to a Provider, or that deposit value is otherwise allocated between them, that arrangement is solely their responsibility. BottleBuddy does not verify whether any deposit amount is legally redeemable or actually redeemed.

Ratings and reviews must be honest, based on first-hand experience, and free from unlawful, abusive, discriminatory, defamatory, or privacy-invasive content. We may remove or restrict ratings and reviews that violate these Terms or applicable law.

10. User content licence

You retain ownership of content you submit, including photos, listing descriptions, messages, ratings, and support reports ("User Content"). You grant BottleBuddy a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, moderate, back up, and otherwise process User Content only as necessary to operate, secure, improve, and enforce the Service.

You must have all rights necessary to upload User Content and to grant this licence. You are responsible for your User Content.

11. Paid features and subscriptions

BottleBuddy may offer optional paid features or subscriptions. Paid features are subject to the separate BottleBuddy Subscription Terms presented before purchase. If you purchase through Google Play, billing, renewal, cancellation, and refund handling may also be governed by the relevant platform terms. If you purchase through the BottleBuddy web flow (bottlebuddy.eu), payments are processed by Stripe. iOS users complete their subscription on the web.

12. Privacy

Our Privacy Policy explains how we collect and use personal data. By using BottleBuddy, you acknowledge that personal data will be processed as described in the Privacy Policy.

13. Moderation, illegal content, and DSA notices

We may review, restrict, remove, disable access to, demote, or otherwise moderate content or accounts where we reasonably believe this is necessary to enforce these Terms, comply with law, protect users, prevent fraud or abuse, or preserve the integrity of the Service.

You may report illegal content, unsafe behaviour, or Terms violations through the in-app reporting tools or by emailing dsa@bottlebuddy.eu. Reports should include enough detail for us to identify the content or conduct, understand the reason for the report, and contact you if appropriate.

Where required by applicable law (including the EU Digital Services Act), we may provide a statement of reasons for certain moderation decisions and make available a complaint or review process. We may use automated tools, manual review, or both, depending on the issue. Final decisions may be made by BottleBuddy personnel or authorised service providers.

14. Availability and changes to the Service

We may modify, suspend, discontinue, or limit parts of the Service at any time, subject to applicable law. We do not guarantee uninterrupted or error-free availability. The current health of the platform is published at bottlebuddy.eu/status.

15. Disclaimers

To the maximum extent permitted by law, BottleBuddy is provided "as is" and "as available" without warranties of any kind. We do not warrant that listings are accurate, that users are trustworthy, that pickups will occur, that bottles are redeemable, that any deposit amount will be obtained, or that the Service will be uninterrupted, secure, or error-free.

16. Limitation of liability

To the maximum extent permitted by law, BottleBuddy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, goodwill, data, or opportunity; failed pickups; user disputes; cash/deposit-value disagreements; property damage; personal interactions between users; or unsuccessful bottle redemption.

To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to the Service is limited to the greater of EUR 100 or the amount you paid to BottleBuddy in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including mandatory EU consumer law.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold BottleBuddy harmless from claims, losses, liabilities, damages, costs, and expenses arising from your User Content, misuse of the Service, unlawful conduct, or breach of these Terms.

18. Suspension and termination

You may close your account at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, created legal or safety risk, harmed other users, or used the Service abusively. Clauses that by their nature should survive termination will continue to apply.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice, such as by email, in-app notice, or website notice. Continued use after the effective date means you accept the updated Terms, unless applicable law requires a different process.

20. Governing law and disputes

These Terms are governed by the laws of Malta. If you are an EU consumer, you retain any mandatory consumer protections available under the laws of your country of residence. Disputes are subject to the courts of Malta, except where mandatory consumer law provides otherwise.
